Case Summary: Lawrence v. MS & RE Kesef Corp., 11-cv-22122 (S.D. Fla.)

On May 13, 2011, plaintiff Duke Lawrence filed a complaint for monetary damages against defendant MS & RE Kesef Corp in the Circuit Court of the Eleventh Judicial Circuit in and for Miami-Dade County, Florida, which was removed to the United States District Court for the Southern District of Florida on the basis of federal question jurisdiction. Plaintiff alleged that defendant violated the Fair Labor Standards Act by failing to pay minimum wages and overtime pay and by retaliating against the plaintiff for complaining of the alleged pay violations. Defendant denied liability.

A jury trial was held from July 9, 2012 through July 11, 2012. The court entered a directed verdict in favor of defendant on plaintiff’s minimum wage claim on July 10, 2012, and the parties stipulated to the dismissal of plaintiff’s overtime pay claim. The jury returned a verdict on July 11, 2012, finding that plaintiff was not retaliated against for engaging in statutorily protected activities. The court entered judgment against plaintiff and in favor of defendant.
