On October 3, 2011, plaintiff William Hill, as Trustee of the William G. Shirley Trust, filed a complaint for declaratory judgment in the United States District Court for the Southern District of Iowa against defendants The Conley Group, Inc., Tom Conley, and Karen Conley. The complaint seeks a declaration resolving priority in favor of plaintiff's interest in a Judgment rendered in the District Court of Polk County, Iowa.
On December 14, 2011, defendants filed a motion to dismiss the complaint, arguing that (1) the court does not have subject matter jurisdiction over the claims; (2) the court does not have authority to overturn state court rulings; and (3) plaintiff's claims are barred by both issue and claim preclusion. Defendants also filed a motion for sanctions, asserting that plaintiff's complaint is frivolous and brought for an improper purpose.
On January 2, 2012, plaintiff filed an opposition to defendants' motions. Plaintiff also moved for sanctions on the basis that defendants' motion for sanctions is frivolous and brought for an improper purpose. The court heard oral argument on the motions on March 15, 2012.
