Bankruptcy Filings Down From 2010 Levels

According to statistics released today by the Administrative Office of the U.S. Courts, bankruptcy petitions filed in the 12-month period ending June 30, 2011 totaled 1,529,560, down 2.7 percent from the 1,572,597 bankruptcy petitions filed in the 12-month period ending June 30, 2010.
Despite the slight drop in overall filings nationwide, the number of bankruptcy filings increased in 19 of the 94 districts. The largest percentage increases in bankruptcy filings were in the Southern District of Florida, with a 15 percent increase over 2010, and the Districts of Utah and the Central District of California, where filings for the 12-month period ending June 30, 2011 increased 13 percent over 2010.
Additional statistics released today include business and non-business filings for the 12-month period ending June 30, 2011 (Table F-2, 12-month); a comparison of June 2010 and 2011 filings (Table F), 3rd quarter filings (Table F-2, 3-month); monthly filings for the 12-month period ending June 30, 2011 (Table F-2, Monthly); and filings per capita.
Business and Non-Business Filings
The overall drop in filings was largely due to a 2 percent decline in non-business or personal bankruptcy filings. Non-business (consumer) filings for the 12-month period ending June 30, 2011 totaled 1,477,426, down from the 1,512,989 non-business filings for June 30, 2010.
Business filings totaled 52,134, down 13 percent from the 59,608 business filings reported for the 12-month period ending June 30, 2010.
Filings by Chapter, 12-month Period Ending June 30
- Chapter 13 filings totaled 432,333, an increase of 2 percent from the 424,242 filings in the same time period in June 2010.
- Chapter 7 filings totaled 1,083,671, down 4 percent from the 1,133,320 Chapter 7 filings in the 12-month period ending June 30, 2010.
- Chapter 11 filings fell 11 percent from 14,272 filings as of June 30, 2010, to 12,714 filings during the 12-month period ending June 30, 2011.
- Chapter 12 filings rose 9 percent to 717 from the 660 Chapter 12 bankruptcies filed as of June 30, 2010.
The Judiciary's Third Quarter Filings
Third quarter filings, the 3-month period ending June 30, 2011, totaled 379,790. For fiscal year 2011, filings for the first quarter (October 1, 2010 –December 31, 2010) totaled 370,080 and second quarter filings (January 1, 2011 – March 31, 2011) totaled 366,178. The federal Judiciary’s fiscal year ends September 30.
