Bankruptcy Filings Near Million Mark for 12-Month Period Ending June 30, 2008

August 27, 2008 — In the 12-month period ending June 30, 2008, there were 967,831 bankruptcy cases filed, according to statistics released today by the Administrative Office of the U.S. Courts. That is a 28.9 percent increase compared to filings for the 12-month period ending June 30, 2007, when cases totaled 751,056. Historic data on bankruptcy filings is available on the Judiciary's website under Bankruptcy Statistics.

Additional statistics released today include business and non-business filings for the 12-month period ending June 30, 2008 (Table F-2, 12-month); a comparison of June 2007 and 2008 filings (Table F), 3rd quarter filings (Table F-2, 3-month); monthly filings for the 12-month period ending June 30, 2008 (Table F-2, Monthly); and filings per capita.

Business and Non-business Filings
Non-business filings for the 12-month period ending June 30, 2008 totaled 934,009 up 28.4 percent from the 727,167 non-business filings for June 30, 2007. Business filings totaled 33,822, up 41.6 percent from the 23,889 reported in June 30, 2007.

Filings by Chapter, 12-month Period Ending June 30
In the 12-month period ending June 30, 2008 increased filings were seen in Chapter 7, 13 and 11, with a slight decrease in Chapter 12 filings.

  • Chapter 7 filings totaled 615,748, up 36.7 percent from the 450,332 Chapter 7 filings in the 12-month period ending June 30, 2007.
  • Chapter 13 filings totaled 344,421, up 16.9 percent from the 294,693 filings in the same time period in June 2007.
  • Chapter 11 filings totaled 7,293, up 30.6 percent from the 5,586 filings during the 12-month period ending June 30, 2007.
  • Chapter 12 filings fell 18.7 percent, dropping to 314 from a total of 386 Chapter 12 bankruptcies filed as of June 30, 2007.

The Judiciary's Third Quarter Filings
Third quarter filings, the 3-month period ended June 30, 2008, totaled 276,510, the highest quarterly filings since the Judiciarys first fiscal year quarter in 2006 (December 31, 2005). So far, filings for the June quarter are the highest of any quarter in fiscal year 2008 (October 1, 2007 - September 30, 2008). First quarter filings totaled 226,413 and second quarter filings totaled 245,695.

Quarterly filings surged in September and December 2005, following implementation of many of the provisions of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA). By March 2006, quarterly bankruptcy filings had dropped substantially.
