At its June 2-3, 2011, meeting, the Committee on Rules of Practice and Procedure approved for transmission to the Judicial Conference the following proposed amendments and new rule:
- Bankruptcy Rules 1007, 2015, 3001, 7054, and 7056, and Official Forms 1, 9A-9I, 10, 10 (Attachment A), 10 (Supplement 1), 10 (Supplement 2), and 25A; and
- Criminal Rules 5, 15, 58, and new Rule 37.
The Committee will now transmit the proposed amendments and new rule to the Judicial Conference with a recommendation that they be approved and transmitted to the Supreme Court. (Under Bankruptcy Rule 9009, the Official Forms are prescribed by the Judicial Conference. Accordingly, the proposed revisions to the forms will not be submitted to the Supreme Court.)
In addition, the Committee also adopted the recommendations of the Advisory Committees on Appellate, Bankruptcy, Civil, Criminal, and Evidence Rules and approved publishing for public comment the following proposed rules and forms amendments:
- Appellate Rules 28 and 28.1, and Appellate Form 4;
- Bankruptcy Rules 1007, 3007, 5009, 9006, 9013, and 9014, and Official Forms 6C, 7, 22A, and 22C;
- Civil Rules 37 and 45;
- Criminal Rules 12 and 34;
- Evidence Rule 803.
The proposed amendments, which are expected to be published in August 2011, will be posted at http://www.uscourts.gov/RulesAndPolicies/FederalRulemaking/PublishedRules.aspx.
Finally, the Committee approved revisions to the Procedures for the Judicial Conference’s Committee on Rules of Practice and Procedure and Its Advisory Rules Committees. The revised Procedures will be transmitted to the Judicial Conference with a recommendation that they be approved.
