Plaintiffs Enargy Power Co. and related parties brought this action against Defendants, former employee Xiaolong Wang and his wife, Cecei Chen, who served as treasurer for Enargy’s Massachusetts corporation. The complaint alleges violations of the Computer Fraud and Abuse Act by Wang and conversion by Chen.

Wang worked for Enargy as the director of research and development, leading the design of various electrical components. Enargy and Wang developed a number of trade secrets, though the parties dispute whether they were intended to be the sole property of Plaintiff. When the relationship between Wang and his employer deteriorated, he encrypted the computer files related to these projects, saved personal copies of the files, and deleted the originals from Enargy’s server.

When Enargy originally hired Wang, they also hired his wife, Chen, as treasurer for its Massachusetts corporation. Chen subsequently removed $330,000 from a corporate bank account. Plaintiffs’ complaint alleges conversion, meaning Chen exercised control over Enargy’s property inconsistent with its ownership rights.

Plaintiffs requested that the court grant a preliminary injunction forcing Wang to provide the password to the computer files and return the files to Enargy, and enjoining Defendants from accessing Plaintiffs’ bank accounts. Plaintiffs also filed a motion to attach Defendants’ real property in Massachusetts to prevent them from selling the property in anticipation of a judgment against them.

This video shows the hearing on Plaintiffs’ Motion for a Preliminary Injunction and Motion to Attach Real Property. The court partially granted the preliminary injunction, ordering Wang to disclose to Plaintiffs the password for the encrypted file and enjoining Defendants from using the bank accounts. The court denied Plaintiffs’ motion to attach real property.
