On January 17, 2012, plaintiff International Logistics, Inc. filed a complaint for declaratory and injunctive relief against defendants Caremoli USA, Inc., Caremoli India Pvt. Ltd., Caremoli SpA, Rizzolio SpA, and Geovita Functional Ingredients SrL in the United States District Court for the Southern District of Iowa. The complaint alleges claims for declaratory judgment, unjust enrichment, conversion, breach of the covenant of good faith and fair dealing, and civil conspiracy arising out of the misdelivery of cargo.

Defendants did not timely respond to plaintiff's complaint. Plaintiff filed a motion for default judgment against defendants. Defendants opposed the motion, asserting that failure to file a response was inadvertent and non-prejudicial. The court heard oral argument on plaintiff's motion on March 20, 2012. On March 22, 2012, the court issued an order denying plaintiff's motion for default judgment.
