Freedom of Speech
The First Amendment protects freedom of speech. Speech is of the utmost importance in a democratic society. It is the means by which citizens share their ideas with one another and with their elected representatives in government. Speech includes both the written and spoken word, and even forms of "expressive speech." Some forms of speech involve more protection than others, e.g., political speech is more highly protected than commercial speech. Certain forms of speech, e.g., inciting individuals to violence and obscenity, are not protected. The Supreme Court is the ultimate arbiter of what constitutes constitutionally protected speech.
