Separation of Powers: Hamdan v. Rumsfeld

The balancing of liberties and safety in terrorism cases presents a timely study of the role of each branch of government. These materials present two ways of exploring the role of the judiciary. The first is a true-to-life simulation of a Supreme Court conference using Hamdan v. Rumsfeld. Students play the parts of the deliberating justices and learn the positions taken in the 2006 case. The second option is an Oxford style debate that stimulates the students' thinking using the rationale of the justices as a starting point.
