Draft Interim Rules and Forms to Implement the Bankruptcy Abuse Prevention
and Consumer Protection Act of 2005

Neither the Advisory Committee on Bankruptcy Rules, the Committee on Rules of Practice and Procedure, nor the Judicial Conference has acted on these proposals. The final proposals may vary from these drafts both as to their form and substance.

The following documents are memoranda and working drafts of proposed Interim Rules and Forms prepared for consideration by the Advisory Committee on Bankruptcy Rules. Additional working drafts will be posted as time permits.

The proposed Interim Rules and Forms will be presented to the Advisory Committee at its meeting in Washington, D.C., on August 3-4, 2005. If approved by the Advisory Committee, the proposed Interim Rules will be transmitted to the Committee on Rules of Practice and Procedure and the Judicial Conference for approval and transmission to the courts for adoption through standing or general orders by each of the courts. The proposed Interim Forms will be transmitted to the Standing Committee and the Judicial Conference for adoption as Official Forms.

Interim Rules and Forms are being proposed because many provisions of the legislation will be effective on October 17, 2005, 180 days after its enactment. The Interim Rules and Forms are expected to apply to bankruptcy cases from October 17, 2005, until final rules and forms are promulgated and effective under the regular Rules Enabling Act process.
