On April 2, 2010 plaintiff Groeneveld Transport Efficiency, Inc. filed a complaint for injunction and money damages against defendant Lubecore International, Inc. in the United States District Court for the Northern District of Ohio. The complaint alleged that defendant's greasing system was confusingly similar in design and appearance to plaintiff's product and caused confusion in the marketplace as to the source, sponsorship, affiliation, and/or association of the products. Plaintiff asserted claims for trade dress infringement, unfair competition, false advertising and misrepresentation of quality, deceptive trade practices, and intentional interference with business relationships. Defendant denied the allegations.

A jury trial was held from October 13, 2011 through October 21, 2011. On October 20, 2011, the jury returned a verdict, finding in favor of plaintiff in the amount of $1,225,000.00. On October 21, 2011, the jury returned a unanimous decision that defendant willfully infringed on plaintiff's trade dress. The court entered judgment on October 26, 2011.
