Plaintiff USCO brought an action against Defendants ValuePart, Inc. (“VPI”), ACE, and REONE, alleging patent infringement. Plaintiff owns a patent for a “method of manufacturing an openable link of a track.” Plaintiff creates split master links, lubricated track assemblies, undercarriage packages, and other products used mainly in bulldozers and construction vehicles. Plaintiff alleges that Defendants infringed on the patent by importing, selling, offering to sell, manufacture, and use products that incorporate Plaintiff’s method of manufacturing the track links.
In this video, Plaintiff and Defendant VPI appear before the Court at a scheduling conference. Plaintiff shows the Court a video of the manufacturing process of the track link at USCO. Plaintiff also brings a track link for the Court to see, and describes USCO’s process of making the track link. The Defendant also shows a track link from VPI, and explains how their track links are manufactured. Defendant alleges that the manufacturing process is different than that of Plaintiff. Defendant also requests a motion to transfer venue to the United States District Court for the Northern District in Illinois. The Court denies Defendant’s motion to transfer venue, and sets the schedule for the remainder of the lawsuit.
