Case Summary: 02-cv-00022

The United States brought this civil enforcement action against the Government of Guam under the federal Clean Water Act to end impermissible discharges from Guam’s Ordot Dump landfill. On March 17, 2008, four years after the parties entered into a consent decree and six years after the commencement of the case,  the court invoked its equity jurisdiction and Rule 70 of the Federal Rules of Civil Procedure and appointed a receiver to manage, supervise and oversee the Solid Waste Management Division of the Government of Guam’s Department of Public Works.
