Pre-Lapse in Appropriations Notice to Contractors

The Judiciary contractor community should read the following notice in case of a lapse in appropriations for FY 2026.

The Administrative Office of the U.S. Courts issues this notice to inform the Judiciary contractor community of potential contract actions during a lapse in appropriations (a Federal Government shutdown).

All Judiciary contractors must continue to meet their contractual obligations—including all terms, conditions, delivery, and performance requirements - unless specifically instructed otherwise by the Judiciary.

During a shutdown, non-excepted government activities cease.  Contract performance may be disrupted by circumstances beyond the control of either party, and invoices cannot be paid.  The Government may also cancel planned procurements, reduce contract scope, suspend work, or terminate contracts for convenience.

If the Judiciary determines that any such action is necessary, or that contractual obligations cannot be met during the lapse, contractors will receive prompt written notice and instructions from the contracting officer for each affected contract.  No separate notice will be issued for contracts unaffected by the lapse.
