Casey v. Department of Defense et al

Case Summary: 12-cv-10246-WGY

This is a case about a female employee on a military base who alleges that her direct supervisor treated her differently than male employees and that she was fired after reporting his threatening actions to the military police on base and to her supervisors, all in violation of her right against retaliation for protected activity under state and federal anti-discrimination laws, breach of contract, and termination in violation of public policy.

Plaintiff worked as a nurse contractor for the Federal Occupational Health (“FOH”) division of the Department of Health and Human Services (“DHHS”) at Hanscom Air Force Base (“Hanscom”) since 2007 (in 2008, STG became the contractor). Plaintiff alleges that since her employment began, she was subjected to persistent and pervasive sexual harassment from Defendant William Carpenter, a Department of Defense employee, in that Carpenter regularly yelled at and berated her but did not treat male co-workers in the same manner.

The harassment allegedly culminated in a physical confrontation in Plaintiff’s office where Carpenter blocked her ability to leave and physically assaulted her when she reached for a telephone by grabbing her wrist and pushing her back. Plaintiff reported the incident to military police and her supervisors and, when she returned, was informed that her contract had been canceled.

The video is of a hearing on STG’s Motion to Dismiss, which was later denied by the judge. Defendants Department of Defense and others were earlier dismissed from the suit. The Department of Health and Human Services and the United States Air Force have been added as defendants.
