The author describes external factors and traditional practices inhibiting the reduction of unnecessary pretrial detention. He gives a history of recent efforts to grapple with this issue, and offers a series of suggestions to determine in a consistent way what exactly constitutes "necessary" versus "unnecessary" detention.
