Plaintiff, Kedem, LLC, brought this action against Defendant, Team International Group of America, alleging patent infringement. The patent at issue, owned by Plaintiff, was for a “vertical grill” electronic egg cooker, named “EGGMASTER.” Plaintiff entered into an exclusive licensing agreement with Defendant to design, market, sell, and distribute the EGGMASTER. The agreement provided that Plaintiff would own all rights, title, and interest in any additional trademark, whether created by Plaintiff or Defendant.
Defendant filed an application to patent a “vertical grill” electronic egg cooker with the trademarked name “ROLLIE.” Defendant intended to use and sell the product. Plaintiff alleges that the Defendant breached the agreement by taking title to the trademark ROLLIE without first consulting Plaintiff. Plaintiff also alleges that the ROLLIE infringes on its patent.
This video proceeding is a Scheduling Conference held on February 27, 2014. The Court ordered Plaintiff to file an Amended Complaint on or before March 11, 2014. Defendant must file an Answer to the Amended Complaint by March 25, 2014. The Court proposed a trial be held sometime in March 2015, if the parties do not settle.
